In this case of first impression, appellants, John and Shahin Coats, appeal a summary judgment in favor of appellee, Farmers Insurance Exchange, contending the trial court erred (1) by granting summary judgment because the homeowners insurance policy in question is either ambiguous or Farmers expressly agreed to remit an amount not to exceed policy limits for each loss sustained during the policy period; and (2) by concluding that appellants claims under former Article 21.55 of the Texas Insurance Code fail as a matter of law. We affirm in part and reverse and remand in part.
